On April 1, 2000, EPIC became effective. Now there are a number of options that can be used to wrap up a person’s affairs upon their death. Probate does not need to be the huge burden that it once was. The personal representative can choose to do much of the estate without the assistance of an attorney or the courts. Having the assistance of an attorney would most likely be beneficial for most estates. A personal representative can choose to have an attorney handle the whole matter under either the supervision of the court or unsupervised with either the informal or formal probate provisions. Even in the most complicated cases the estate may need only be brought to the court to have specific determinations made, if that is the wish of the personal representative.
My office will provide only the services that are necessary or requested. I will be happy to stand back and be available for questions and guidance. On the other hand I can do much of the work for the personal representative, if that is what is preferred.
I will also represent individuals that disagree with a personal representative in the handling of an estate.
